Terms of Use
The FormConnect apps (FormConnect, FormConnect Pro and FormConnect Pro+) are owned by FormConnections, Inc. Use of these apps are conditioned on your acceptance of and compliance with the following Terms of Use (“Terms”). These Terms apply to all users of the FormConnect apps. If you disagree with any part of the Terms, then you are not authorized to continue using the app.
Purchase of FormConnect Apps:
The FormConnect apps are made available to you when you purchase them through the Apple App Store. Your license to use these apps is subject to your prior acceptance of Apple’s Licensed Application End User License Agreement.
Scope and Use of License:
FormConnections, Inc. grants to you a non-exclusive, personal, limited right to install and use the FormConnect apps. The license permits a single user to install and use either of these apps on multiple devices. However, it does not permit a single user license to be installed on multiple devices for the purposes of sharing it with multiple users. This requires the purchase of a separate license for each user of the app.
The license is limited to a nontransferable license for use on any Apple-branded product running iOS 12 or higher, including but not limited to an iPad, iPhone or Mac device that you own or control and as permitted by the usage rules set forth in the App Store Terms and Conditions. This license does not allow you to use the FormConnect app on any Apple Device that you do not own or control. You may not rent, lease, lend, sell, transfer redistribute, or sublicense the FormConnect app and, if you sell your iOS Device or Mac to a third party, you must remove the FormConnect app from the iOS or Mac Device. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the FormConnect app. Any attempt to do so is a violation of the rights of the Licensor. If you breach this restriction, you may be subject to prosecution and damages.
Loss of Forms and Data:
FormConnections, Inc. is not responsible for the loss of any forms or data that you create through the use of the FormConnect apps. It is your responsibility to backup your forms and data on a regular basis. Backing up of your data can be accomplished via Apple’s iCloud backup service or automatically when you subscribe to FormConnect Pro+ and have Form Syncing enabled.
Access to Data:
When you use the FormConnect apps, any data collected is stored locally on the device and is only accessible by the owner of that device. FormConnections, Inc. does not have access to these forms or any of the data stored on them.
Limitations of Liability:
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL FORMCONNECTIONS, INC. BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION.
Intellectual Property:
All copyrights, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) that are part of the FormConnect family of apps belong to FormConnections, Inc. and we reserve all rights to this content. Nothing in the Terms of Use grants you a right or license to use any trade mark, design right or copyright owned by or controlled by FormConnections, Inc.
User Created Content:
The forms that you create using the FormConnect apps are your property and you can do with them as you so desire. They can be exported via email or to a cloud service such as Dropbox, Box, Microsoft OneDrive or Google Drive and can be shared with other FormConnect users.
Payment Terms:
Payment for the FormConnect apps is managed through Apple’s App Store and will be charged to your Apple ID account at the confirmation of a purchase.
Indemnities:
Indemnitor agrees to indemnify, defend, and hold harmless Indemnitee and each of its respective officers, directors, partners, employees, agents, and assigns any of them from all claims, suits, legal actions, assessments, deficiencies, and charges brought against the Indemnitee, and for any costs, fees, liabilities, damages, losses, expenses, and associated attorney fees arising from or incidental to the aforementioned.
Warranties:
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR
PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED
T O , T H E I M P L I E D WA R R A N T I E S A N D / O R C O N D I T I O N S O F MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. LICENSOR DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE LICENSED APPLICATION, THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE LICENSED APPLICATION OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE LICENSED APPLICATION OR SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
Dispute Resolution:
The laws of the State of California, excluding its conflicts of law rules, govern this license and your use of the Licensed Application. Your use of the Licensed Application may also be subject to other local, state, national, or international laws.
